1. Agreement to Terms
By accessing or using ViViDly — including the web application at myvividly.web.app,
the Chrome browser extension, the admin dashboard, or any associated services — you enter into a legally
binding agreement with ViViD App Studio (ViViD Global Services) and agree to be bound
by these Terms of Service.
2. Eligibility
To use the Service, you must:
- Be at least 13 years of age (or 16 years in the European Union / UK)
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under any applicable law or court order
3. Account Registration & Security
You may register using Email/Password, Google OAuth, or use Guest Mode (limited functionality). You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access at support@vividappstudio.com.
We reserve the right to suspend or terminate your account without prior notice if you violate these Terms, engage in fraudulent activity, or attempt to circumvent subscription limits or security measures.
4. Acceptable Use Policy
You agree NOT to use ViViDly to:
- Generate content that is illegal, harmful, threatening, abusive, defamatory, or pornographic
- Generate content involving minors in any sexual context — strictly prohibited and reported to authorities
- Create instructions for weapons, explosives, bioweapons, hacking tools, or illegal drugs
- Produce content promoting terrorism, hate speech, or discrimination
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service
- Use automated bots or scrapers to access the Service
- Bypass subscription limits or payment walls through technical means
- Resell or sublicense access to the Service without our written permission

All payments are processed securely by Razorpay. Subscriptions auto-renew unless cancelled before the renewal date. We reserve the right to change prices with 30 days' notice.
6. Intellectual Property Rights
All elements of the Service — including the ViViDly name, logo, character design (ViViDly-Face), UI design, source code, and documentation — are the exclusive property of ViViD App Studio, protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only. You may not copy, modify, distribute, or create derivative works of the Service.
7. AI Content Disclaimer
AI-generated responses are produced autonomously and may be inaccurate. They do not constitute professional legal, medical, financial, or psychological advice. ViViD App Studio does not endorse, verify, or guarantee any AI-generated output.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIVID APP STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
9. Governing Law
These Terms are governed by the laws of India, without regard to conflict of law principles. Disputes shall be subject to the exclusive jurisdiction of competent courts in India. See our Dispute Resolution Policy for the full dispute procedure.
10. Changes to Terms
We reserve the right to update these Terms at any time. Material changes will be notified via the app interface or email at least 7 days before they take effect. Continued use after the effective date constitutes acceptance.
